1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your use of team34.ca (the “Site”), operated by Team 34 Inc. (“Team 34,” “we,” “us,” or “our”), a company based in Ontario, Canada. By visiting the Site, using the Fit-Out Planner, or submitting any form on the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. What the Site Is

The Site describes Team 34’s retail and commercial fit-out contracting services in the Greater Toronto Area, and provides two self-serve tools:

• The 3-Week Retail Fit-Out Planner (“Planner”) — an estimating tool that generates a planning range based on the information you provide.
• Careers — a page where you can submit a job application, optionally with a resume.

Nothing on the Site, including any figure produced by the Planner, is a quote, an offer to contract, or a guarantee of price, schedule, or scope. A binding price requires a site visit, drawings, and a written proposal signed by both parties. Figures exclude HST, design fees, FF&E, signage, IT/AV/security, and owner-supplied equipment unless a proposal says otherwise.

3. Accuracy of Information You Provide

The Planner’s output is only as good as the information you enter. You’re responsible for providing accurate details about your space, timeline, and budget. Team 34 is not liable for any decision you make based on a planning range generated before a site visit.

4. Job Applications

Submitting an application through the Careers page does not create an employment relationship, guarantee an interview, or guarantee an offer of employment. Team 34 is an equal opportunity employer and evaluates candidates without regard to any ground protected under the Ontario Human Rights Code. Do not submit an application on behalf of someone else without their knowledge and consent.

5. Acceptable Use

When using the Site, you agree not to:

• Submit false, misleading, or fraudulent information through any form;
• Use automated tools to scrape, spam, or overload the Site or its forms (ordinary search-engine crawling is fine);
• Attempt to bypass the Site’s spam or security protections;
• Upload a resume or file that contains malicious code or infringes someone else’s rights;
• Use the Site for any unlawful purpose.

6. Intellectual Property

The Site’s design, text, graphics, and the Team 34 name and logo are the property of Team 34 Inc. or its licensors, unless otherwise noted. You may view and print pages for your own personal, non-commercial reference. You may not reproduce, republish, or use them commercially without our prior written consent.

7. Third-Party Services

The Site is built on Cloudflare’s platform (hosting, spam-filtering via Cloudflare Turnstile, storage, and email delivery), loads fonts from Google Fonts, and uses Google Analytics to measure site usage. Your use of the Site is also subject to those providers’ own terms and privacy practices where applicable. See our Privacy Policy for more detail on what data those providers process.

8. No Warranty

The Site and its tools are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We don’t warrant that the Site will be uninterrupted, secure, or error-free, or that the Planner’s output will match final construction pricing.

9. Limitation of Liability

To the fullest extent permitted by the laws of Ontario and Canada, Team 34 Inc. will not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Site, including reliance on any planning range, estimate, or content provided through it. Nothing in these Terms limits liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold Team 34 Inc. harmless from any claim or demand arising out of your misuse of the Site or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or the Site will be subject to the exclusive jurisdiction of the courts located in Ontario.

12. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continuing to use the Site after changes take effect means you accept the updated Terms.
